The new Law on Marks and Geographical Indications /LMGI/ came into force.
It abolished the requirement for graphical representation of the sign when applying for a trade mark registration. As a consequence, trade marks can now be represented in any suitable form through generally available technologies, provided that their presentation is clear, precise, self-contained, easily accessible, intelligible, durable and objective.
This change introduces some new types of trade marks that had not existed in Bulgaria till now. The new types of trade marks are the position mark, the pattern mark, the motion mark, the multimedia mark, the hologram mark and the sound mark represented by an audio file, which were not possible up to 17.12.2019 due to the requirement for graphical representation.
Now all individuals and companies can apply for registration of the new types of trade marks.
You can learn more about the new types of trade marks and the way they should be presented in our article Trade marks in Bulgaria – implementation of the new European rules.
